Terms of Use
The rules and conditions for using HabitBox.
Last updated: 23 September 2026
These are the Terms of Use for HabitBox. They are also the End User Licence Agreement (EULA) for the HabitBox app. Here is the short version:
- HabitBox is made by Iaroslav Morgunov, a sole trader in Porto, Portugal, trading as Last Stand Studio.
- HabitBox is a habit tracker for iPhone and Android. You don't need an account.
- Your habits are stored on your phone. On iPhone, if you're signed in to iCloud, a copy is also kept in your own private iCloud. We don't receive your habit data unless you send it to us.
- The app is free to use, with limits. HabitBox Plus unlocks more. Apple or Google bills you for it, and a subscription renews automatically until you cancel it in your App Store or Google Play settings.
- Apple and Google handle refunds. Your legal rights as a consumer, including the EU right of withdrawal where it applies, are not affected.
- You are responsible for backing up your data. We can't recover data we never had.
- HabitBox is not medical advice.
- Portuguese law applies, but you keep the consumer protections of the country where you live.
This summary is here to help you. The full Terms below are the ones that apply.
1. Who we are
HabitBox is made and run by Iaroslav Morgunov, an individual sole trader (not a company) trading as Last Stand Studio. The App Store and Google Play list HabitBox's developer as Iaroslav Morgunov.
- Postal address: Rua Alfredo Keil 571, 4150-047 Porto, Portugal
- Email (support, privacy and legal): support@habitbox.app
- Phone: +351 924 331 054
- Tax number (NIF): 310038588
- Website: habitbox.app
In these Terms, "we", "us" and "our" mean Iaroslav Morgunov. "You" means the person using HabitBox.
2. About these Terms
These Terms cover:
- the HabitBox app for iPhone and Android (the "app"), including the iPhone app on any other Apple device it runs on;
- HabitBox Plus, the paid upgrade inside the app; and
- our website, habitbox.app, including its articles and free tools.
By downloading, installing or using HabitBox, you agree to these Terms. If you don't agree, please don't use HabitBox.
Two other things also apply:
- Our Privacy Policy explains what data is processed and how. It is a separate document, not part of these Terms, but please read it.
- When you download the app or buy HabitBox Plus, the terms of the store you use (Apple's App Store or Google Play) also apply. See sections 12 to 14.
If you are a consumer, nothing in these Terms takes away rights that the law gives you and that a contract cannot remove.
3. What HabitBox is
HabitBox is a habit tracker for iPhone and Android. You can create habits, check them off, track progress toward a target, see your streaks and stats, and set reminders. On iPhone there is also a home screen widget.
How it works:
- No account. You don't sign up or log in. We don't ask for your name, email address or age.
- Your data is stored on your device. Your habits, check-ins and settings are stored in the app on your phone. We don't run a server that stores them, and we never receive them unless you send them to us.
- iCloud sync (iPhone only). If you're signed in to iCloud, HabitBox automatically saves a copy of your habits, check-ins and some settings to the private iCloud database of your Apple Account, using Apple's CloudKit. It belongs to your iCloud account, and we can't see it. To stop this, turn off iCloud for HabitBox in your iPhone's iCloud settings, or sign out of iCloud. There is no switch for this inside the app.
- Android. HabitBox has no cloud sync on Android. If you've turned on Android's device backup, Android may include HabitBox's data in your backup to your Google account. Android and Google control that, not us.
- Reminders and other notifications, such as streak alerts and weekly recaps, are scheduled on your phone by iOS or Android. We don't send them from a server.
Our website has articles and free tools, such as timers, calculators and quizzes. The tools run in your browser. They are for general information only (see section 9). The website sets no cookies and runs no advertising or tracking tools. Its only analytics tool is Fathom, which is cookie-free and doesn't identify you, as our Privacy Policy explains. If you press play on a video, YouTube may store data in your browser (see our Privacy Policy).
Our Privacy Policy has the full details, including what the app shares with the services it relies on, such as Apple, Google and RevenueCat.
4. Who can use HabitBox
HabitBox is rated 4+ on the App Store and "Everyone" on Google Play, and it doesn't need an account. Anyone can use the free app. Please keep these points in mind:
- If you're under 18, ask a parent or guardian before you buy HabitBox Plus, and read these Terms together.
- If you're under 13 (or under the age at which you can agree to online services on your own where you live), please use HabitBox only with a parent's or guardian's permission.
- Parents and guardians can approve purchases with Apple's Ask to Buy or with purchase approvals in Google Family Link.
5. Your licence to use HabitBox
The app is licensed to you, not sold. It stays ours.
We give you a personal, non-exclusive, non-transferable licence to download and use HabitBox on devices you own or control, for your own non-commercial use. This licence is subject to these Terms and to the rules of the store you got HabitBox from. If you got it from the App Store, section 13 also applies.
You may not, and may not help anyone else to:
- copy or change the app, or make works based on it, except as the law allows;
- sell, rent, lend, share or sublicense the app, except through store features such as Family Sharing;
- reverse engineer, decompile or disassemble the app, except where the law gives you a right to do so that a contract cannot remove;
- get around, disable or interfere with HabitBox Plus, the limits of the free version, or any security feature;
- remove or change any copyright, trademark or other notice; or
- use HabitBox for anything unlawful.
HabitBox includes open-source software. Those parts come with their own licences, and nothing in these Terms limits your rights under those licences.
6. HabitBox Plus
What Plus includes
The free version of HabitBox has limits, including on how many active habits you can have. HabitBox Plus removes those limits and unlocks extra features, such as unlimited habits, multiple reminders per habit, archiving habits, and exporting and importing your data. The HabitBox Plus screen in the app shows what's included when you buy.
Plans and prices
HabitBox Plus is sold as an auto-renewing subscription. The billing periods on offer (for example, monthly or yearly) can change over time. The app shows which ones are available to you. Before you confirm, the app and Apple's or Google's payment screen show the plan, its billing period and its price in your local currency. Prices can differ between countries.
Payment and automatic renewal
- Apple or Google bills you, not us. Payment is charged to your Apple Account or Google account when you confirm the purchase or, if your plan starts with a free trial, when the trial ends. We never see your card details.
- If a plan comes with a free trial, the app shows you, before you start, how long the trial lasts and the price you'll pay after it. When the trial ends, your paid subscription starts automatically and you're charged that price, unless you cancel before the trial ends (on the App Store, at least 24 hours before it ends).
- Your subscription renews automatically for the same billing period unless you cancel it before the current period ends. On the App Store, cancel at least 24 hours before the current period ends.
- On the App Store, Apple may charge you for the renewal in the 24 hours before the current period ends.
- The renewal price is your current price, unless you have been told about a price change (see "Price changes" below).
How to cancel or manage your subscription
Apple and Google handle billing, so you manage and cancel your subscription in your store account:
- iPhone: open Settings, tap your name, then tap Subscriptions. Or open the App Store, tap your profile picture, then tap Subscriptions. You can also go straight to your Apple subscriptions. Apple's guide: Cancel a subscription from Apple.
- Android: open the Google Play Store app, tap your profile icon, then Payments & subscriptions, then Subscriptions. You can also go straight to your Google Play subscriptions. Google's guide: Cancel, pause, or change a subscription on Google Play.
Deleting the app does not cancel your subscription.
When you cancel, you keep HabitBox Plus until the end of the period you've paid for. After that, HabitBox goes back to the free version. We don't delete any of your habits when this happens. Habits you already have keep working. You just can't use Plus features, or add habits or bring back archived ones beyond the free version's limits.
Cancelling stops future renewals. It doesn't refund the current period on its own. See section 7 for refunds.
Price changes
We may change the price of HabitBox Plus. A price change never affects a period you've already paid for. If your subscription price goes up, Apple or Google will tell you before the new price applies, under their rules. If you don't want to pay the new price, you can cancel before your next renewal. Where Apple or Google need your agreement to a price increase and you don't give it, your subscription ends at the end of the current period.
Lifetime purchases
We have also offered HabitBox Plus as a one-time "Lifetime" purchase. If you bought it:
- you paid once, and it doesn't renew or expire;
- we honour it: we won't turn it into a subscription or ask you to pay again for the Plus features it unlocks; and
- if we ever stop offering HabitBox, section 15 applies, and your legal rights are not affected.
Restoring purchases
Your purchase is linked to the Apple Account or Google account you used to buy it, not to a HabitBox account. If you reinstall HabitBox or get a new phone, or if Plus doesn't unlock after you've paid, tap Restore purchase on the HabitBox Plus screen while signed in with the same Apple Account or Google account. Purchases don't carry over between the App Store and Google Play. If restoring doesn't work, please contact us.
If you use Apple Family Sharing, some purchases can be shared with your family group, as Apple's rules allow.
To check whether you have HabitBox Plus, the app uses a service called RevenueCat, which confirms your purchase with Apple or Google (see section 12).
7. Refunds and your right of withdrawal
Apple and Google handle the sale of HabitBox Plus, including payments and refunds. Whether you get your money back depends on their refund policies and on your legal rights, which these Terms don't limit.
Asking for a refund
- App Store: request a refund at reportaproblem.apple.com. Apple's guide: Request a refund for apps or content that you bought from Apple. We can't issue refunds for App Store purchases ourselves.
- Google Play: see Google Play's refund policies. You can also contact us. In some cases we can refund a Google Play order ourselves.
Your 14-day right of withdrawal
If you're a consumer in the EU, and in some other countries, you normally have 14 days to withdraw from an online purchase without giving a reason. Because Apple or Google sells HabitBox Plus to you, you use this right with them:
- App Store: in the Purchase History of your Apple Account, select the order and choose "Withdraw Transaction", or email rightofwithdrawal@apple.com. The Apple Media Services Terms explain the details.
- Google Play: tell Google Commerce Limited within the 14 days, as the Google Play Terms of Service explain. They include a model withdrawal form you can use.
You can also write to us and we'll help.
How the right works depends on whether the law treats your purchase as digital content or as a digital service:
- Digital content supplied straight away (for example, Plus unlocking as soon as you pay): you lose the right of withdrawal once supply has started, but only if you expressly agreed to supply starting within the withdrawal period, you acknowledged that you would lose the right, and you received confirmation of this. If any of these is missing, you keep the right, and you don't have to pay for what you've already received.
- Digital service (such as an ongoing subscription): you can still withdraw within the 14 days. If you asked for the service to start straight away, you may have to pay for the part you used before you withdrew.
Your other legal rights
If HabitBox Plus doesn't work as described, the law gives you rights as a consumer, known as the legal guarantee of conformity. For a subscription, we are responsible for any such problem for as long as we supply HabitBox Plus to you. Depending on where you live, these can include having the problem fixed, getting a price reduction, or ending the contract and getting your money back. Please contact us first so we can try to fix the problem. Nothing in these Terms limits these rights.
8. Your data and backups
Your habits are yours. We claim no rights to them, and we never receive them unless you send them to us, for example with a support email.
Where your data is kept
- On your phone, inside the app.
- In your private iCloud (iPhone only), as described in section 3.
- In automatic backups that the app saves on your phone, at most one a day on days you use the app. It keeps the 7 most recent. You can restore them for free in Settings, under "Restore from Backup". They are stored on the same phone, so they are deleted with the app. On their own, they won't help if you lose the phone, unless your device backup includes them.
- In your device backups, if you use them, for example an iPhone backup or Android's backup to your Google account. Apple and Google control these.
- In files you export (a HabitBox Plus feature). You choose where an exported file goes. After that, keeping it safe is up to you.
You are responsible for your backups
Your data lives on your devices and in your own accounts, so you are responsible for backing it up. Deleting the app, or resetting or losing your phone, can permanently remove data that isn't backed up somewhere else.
We can't recover data we never had. We can't see, restore or rebuild your habits for you.
Export and import are part of HabitBox Plus. They let you save your data to a file and load it back in.
Deleting your data
Deleting a habit, or the app, doesn't always remove every copy, such as copies in iCloud or in your device backups. Our Privacy Policy explains how to remove them.
9. Health and wellbeing
HabitBox helps you keep track of habits. It is not a medical device, and it doesn't give medical, mental health, nutrition or fitness advice.
- Tips, suggestions, streaks and stats in the app, and the articles and tools on our website, are general information only. Website calculators give estimates, not a diagnosis.
- Talk to a doctor or another qualified professional before making changes that could affect your health. That includes starting a new exercise or diet plan, and cutting down on alcohol or other substances, which can be risky without medical support.
- Don't rely on HabitBox reminders for anything where a missed reminder could harm you, such as taking medicine. Notifications can be delayed or blocked, for example if they are turned off, a Focus or Do Not Disturb mode is on, or your phone's battery settings stop them.
- In an emergency, contact your local emergency services (112 in the EU).
10. Acceptable use
When you use HabitBox or our website, please don't:
- break the law or infringe anyone's rights;
- try to get unauthorised access to, disrupt, overload or damage the app, our website, or the services they rely on;
- introduce viruses or other harmful code;
- send us, or enter in our feedback survey, anything unlawful, abusive or harmful, or other people's personal data without their permission; or
- use the HabitBox name or logo in a way that suggests we endorse you, without our permission.
11. Intellectual property and feedback
The app and our website, and everything in them, belong to us or to the people who licensed them to us. That includes the HabitBox name, logo, design, text, graphics and code. These Terms don't give you any rights in them, except the licence in section 5 and the right to use our website as intended.
You're welcome to share links to our website and to quote short parts of our articles with a link back, as the law allows. You may also embed our free tools on your own website using the embed code on each tool's page, as long as you keep the attribution link under the tool. Embedded tools are counted by our cookie-free analytics (Fathom), as our Privacy Policy explains. We may stop offering embeds at any time. Please ask us before republishing anything more.
The habits and other content you create in the app stay yours.
If you send us ideas, suggestions or feedback, we may use them to improve HabitBox without paying you. Please don't send us anything you want to keep confidential.
12. Third-party services
HabitBox relies on services run by other companies. Their own terms apply when you use them, and you must follow them. The same goes for your mobile network's or internet provider's terms.
- Apple App Store distributes the iPhone app. It sells HabitBox Plus, takes payment, and handles cancellations and refunds. For buyers in the EU, the seller is Apple Distribution International Ltd. Terms: Apple Media Services Terms.
- Apple iCloud (CloudKit) keeps a copy of your habits, check-ins and some settings in your private iCloud database (iPhone only). Terms: iCloud Terms and Conditions.
- Google Play distributes the Android app. It sells HabitBox Plus, takes payment, and handles cancellations and refunds. For buyers in the EEA, the seller is Google Commerce Limited. Terms: Google Play Terms of Service.
- RevenueCat confirms your purchases with Apple or Google so the app knows whether to unlock HabitBox Plus. On iPhone it also receives Apple Ads attribution data. It doesn't receive your habits, your name or your email address. Details: our Privacy Policy.
- Tally hosts our optional feedback survey, which you can open from the app's Settings. Terms: Tally Terms.
We don't control these services. This doesn't reduce our own responsibility for HabitBox under these Terms and the law.
13. Extra terms for the App Store version
If you got HabitBox from Apple's App Store, the following terms also apply. Apple requires them. If they conflict with anything else in these Terms, this section applies to the App Store version. None of it reduces your rights as a consumer under the law.
- Agreement with us, not Apple. These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for HabitBox and its content. These Terms don't set usage rules for HabitBox that conflict with the Apple Media Services Terms.
- Scope of licence. Your licence to use HabitBox is non-transferable and limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms. Other accounts associated with you may also access and use HabitBox through Family Sharing, volume purchasing or Legacy Contacts.
- Maintenance and support. We alone are responsible for maintenance and support for HabitBox, as described in these Terms or as required by law. Apple has no obligation to provide any maintenance or support services for HabitBox.
- Warranty. We alone are responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If HabitBox fails to conform to any applicable warranty, you can notify Apple, and Apple will refund the purchase price, if any, that you paid for HabitBox. To the maximum extent permitted by law, Apple has no other warranty obligation for HabitBox. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility, not Apple's.
- Product claims. We, not Apple, are responsible for handling any claims by you or anyone else relating to HabitBox or your possession or use of it. This includes: (i) product liability claims; (ii) any claim that HabitBox fails to meet an applicable legal or regulatory requirement; and (iii) claims under consumer protection, privacy or similar laws. These Terms don't limit our liability to you beyond what the law allows.
- Intellectual property claims. If anyone claims that HabitBox, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- Legal compliance. You may use the App Store version of HabitBox only if you are not located in a country that is subject to a U.S. Government embargo or that the U.S. Government has designated as a "terrorist supporting" country, and you are not on any U.S. Government list of prohibited or restricted parties. By downloading HabitBox from the App Store, you confirm that both of these are true.
- Developer name and address. Please send any questions, complaints or claims about HabitBox to us: Iaroslav Morgunov (Last Stand Studio), Rua Alfredo Keil 571, 4150-047 Porto, Portugal; phone +351 924 331 054; email support@habitbox.app.
- Third-party terms. When you use HabitBox, you must follow any third-party agreements that apply to you, such as your mobile data or internet service agreement.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right (and is treated as having accepted the right) to enforce them against you as a third-party beneficiary.
14. Extra terms for the Google Play version
If you got HabitBox from Google Play:
- These Terms are between you and us. Google is not a party to them. We, not Google, are responsible for HabitBox and for supporting it.
- Your use of Google Play, and anything you buy through it, is also covered by the Google Play Terms of Service. For buyers in the EEA, HabitBox Plus is sold by Google Commerce Limited.
- Google handles payments, cancellations and refunds under its own policies (see sections 6 and 7). Those policies apply alongside your legal rights, not instead of them.
15. Changes to HabitBox and availability
We keep working on HabitBox, so it will change over time. We may change it:
- to fix bugs or security problems;
- to keep it working with new versions of iOS and Android, or with changes to Apple, Google or other services it relies on;
- to follow the law or App Store and Google Play rules;
- to improve existing features or add new ones; or
- to remove features that few people use or that we can no longer reasonably support.
Changes never cost you extra for a period you've already paid for. If a change makes HabitBox Plus worse for you in more than a minor way, we'll tell you clearly and in advance, for example in the app, in its update notes on the App Store or Google Play, or on this website. You can then end your subscription free of charge within 30 days of being told or of the change, whichever is later. We'll make sure you get a refund for the part you haven't used. If you have a Lifetime purchase, your legal rights in this situation are not affected.
We can't promise that HabitBox will always be available in every country, or on every device or operating system version. Older versions of iOS and Android may stop being supported.
If we decide to stop offering HabitBox, we'll try to give you reasonable notice. We'll stop selling and renewing subscriptions. Your data stays on your phone and in your own accounts. Your legal rights for any period you've paid for, and for Lifetime purchases, are not affected.
16. Our responsibility to you
We work hard to make HabitBox reliable. But like all software, it may sometimes have bugs or be unavailable.
If we break these Terms or fail to use reasonable care and skill, we are responsible for loss or damage you suffer that is a foreseeable result. Loss is foreseeable if it was obvious it would happen, or if both of us knew it might happen when you started using HabitBox.
To the extent the law allows, we are not responsible for:
- loss or damage that wasn't foreseeable;
- problems caused by events outside our reasonable control, such as outages at Apple, Google or RevenueCat, or changes to iOS or Android;
- loss of data, to the extent you could have avoided it by keeping backups as described in section 8; or
- business losses, such as lost profits, revenue or business opportunities. HabitBox is for personal use.
Nothing in these Terms excludes or limits our liability for:
- death, personal injury, damage to health, or harm to a person's moral integrity (such as their dignity or reputation);
- fraud or fraudulent misrepresentation;
- harm caused intentionally or through gross negligence, by us or by anyone acting for us; or
- anything else the law doesn't allow us to exclude or limit, including your legal rights as a consumer, such as your rights when digital content or a digital service doesn't match the contract.
17. Ending these Terms
You can stop using HabitBox at any time by deleting the app. If you have a subscription, cancel it in your App Store or Google Play settings as well (see section 6), because deleting the app doesn't cancel it.
We may end or suspend your licence to use HabitBox if you seriously or repeatedly break these Terms, for example by getting around HabitBox Plus. Where it's reasonable, we'll warn you first and give you a chance to put things right. If we end your licence when you haven't broken these Terms, you keep your legal rights, including a refund for any unused period you've paid for.
When these Terms end, your licence ends and you must stop using the app. Sections that are meant to continue, such as sections 11, 16, 19 and 20, stay in effect. Your data stays on your devices and in your own accounts.
18. Changes to these Terms
We may update these Terms for a valid reason: a change in the law or in regulators' guidance, a change in App Store or Google Play rules, a change to HabitBox's features or to the services it relies on, or to make these Terms clearer. We'll publish the new version on this page with a new "Last updated" date.
If a change is significant, we'll also tell you before it takes effect, for example in the app or in its release notes. Changes don't apply to the past.
If you don't agree to the new Terms, you can stop using HabitBox and cancel your subscription before they take effect. If a change is to your disadvantage and affects a period you've already paid for, you can end your subscription free of charge and get a refund for the unused part. If you keep using HabitBox after the change takes effect, the new Terms apply to you.
19. Governing law and courts
These Terms are governed by Portuguese law.
If you are a consumer, you also keep the protection of the mandatory laws of the country where you live. Choosing Portuguese law doesn't take that protection away. For example, if you live in another EU country, you can still rely on the consumer protection rules there that a contract can't override.
Where claims can be brought:
- Consumers in the EU: you can bring a claim against us in the courts of Portugal or in the courts of the EU country where you live. We can only bring a claim against you in the courts of the EU country where you live.
- Consumers outside the EU: you can bring a claim against us in the courts of Portugal. If the law of the country where you live lets you bring the claim in your local courts, you keep that right.
- Business users: the courts of Porto, Portugal, have exclusive jurisdiction.
20. Complaints and consumer disputes
If something goes wrong, please email us at support@habitbox.app first. Most problems can be sorted out quickly. For problems with a payment, you can also contact Apple or Google.
Consumer arbitration in Portugal
If you're a consumer and we can't settle a complaint together, you can take it to a consumer arbitration centre in Portugal. For consumer disputes worth up to €5,000, Portuguese law lets you choose arbitration, and we must take part. These are the consumer arbitration centres we are bound by:
- CNIACC (Centro Nacional de Informação e Arbitragem de Conflitos de Consumo, the National Centre for Consumer Information and Arbitration), Rua D. Afonso Henriques, 1, 4700-030 Braga, Portugal: www.cniacc.pt. CNIACC covers any area of Portugal that no regional centre serves.
- CACCL (Centro de Arbitragem de Conflitos de Consumo de Lisboa), Lisbon area: www.centroarbitragemlisboa.pt
- CICAP (Centro de Informação de Consumo e Arbitragem do Porto), Porto area: www.cicap.pt
- CACRC (Centro de Arbitragem de Conflitos de Consumo da Região de Coimbra), Coimbra region: www.cacrc.pt
- TRIAVE (Centro de Arbitragem de Conflitos de Consumo do Vale do Ave), Ave, Tâmega and Sousa area: www.triave.pt
- CIAB (Centro de Informação, Mediação e Arbitragem de Consumo), Minho and Alto Tâmega area: www.ciab.pt
- CIMAAL (Centro de Informação, Mediação e Arbitragem de Conflitos de Consumo do Algarve), Algarve: www.consumoalgarve.pt
- CACC Madeira (Centro de Arbitragem de Conflitos de Consumo da Região Autónoma da Madeira), Madeira: www.madeira.gov.pt/cacc
Each regional centre's website lists the municipalities it covers.
Complaints book
You can also make a complaint in Portugal's electronic complaints book (Livro de Reclamações) at www.livroreclamacoes.pt.
21. General
- Severability. If a court decides that part of these Terms is invalid or can't be enforced, the rest of these Terms stays in effect.
- No waiver. If we don't enforce a right straight away, we can still enforce it later.
- Transfer. We may transfer our rights and obligations under these Terms to another person or business, for example if HabitBox is sold. We'll tell you if this happens, and it won't reduce your rights. You can't transfer your rights under these Terms to anyone else, except through store features such as Family Sharing.
- Third-party rights. Apart from Apple's rights under section 13, no one else has rights under these Terms.
